Terms & Conditions

Last updated October 21, 2026

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and Q Group NY LLC ("Q Group," "we," "us," or "our") governing your access to and use of Check Snapper, including the Check Snapper website, software, applications, features, services, and related products (collectively, the "Service").

BY CREATING AN ACCOUNT, ACCESSING, OR USING CHECK SNAPPER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT CREATE AN ACCOUNT OR USE THE SERVICE.

If you are using Check Snapper on behalf of a business, organization, or other entity, you represent and warrant that you have authority to bind that entity to these Terms. In that situation, "you" and "Customer" include that entity.

1. Nature of the Service

Check Snapper is a software tool that may allow customers to store bank and vendor information, create and print checks, schedule or generate checks in bulk, maintain check registers, and use other financial or administrative features made available by Q Group from time to time.

Check Snapper is a software service and is not a bank, financial institution, payment processor, money transmitter, accounting firm, tax advisor, legal advisor, financial advisor, or check-guarantee service.

What Check Snapper does not do:

You are responsible for having sufficient funds in your bank account and for every check you write. Checks are processed by your bank, not by Check Snapper.

Q Group does not control, approve, process, clear, deposit, cash, or guarantee any check created or printed through Check Snapper.

The Customer is solely responsible for determining whether its bank, financial institution, recipient, vendor, payroll provider, governmental agency, or other intended recipient accepts checks created or printed using the Service.

2. Customer Has Sole Responsibility for Every Check

THE CUSTOMER IS ENTIRELY RESPONSIBLE FOR EVERY CHECK CREATED, PRINTED, SCHEDULED, STORED, OR OTHERWISE GENERATED THROUGH CHECK SNAPPER.

You are solely responsible for:

Q Group is not responsible for the accuracy, legality, validity, acceptance, processing, payment, rejection, alteration, duplication, loss, theft, delay, or unauthorized use of any check created or printed through Check Snapper.

You must independently verify every check before it is used.

3. No Responsibility for Banking or Financial Transactions

Q Group does not guarantee that:

Any relationship between the Customer and its bank, financial institution, vendor, employee, customer, recipient, or other third party is solely between the Customer and that third party.

Q Group has no responsibility for disputes between the Customer and any bank or third party.

4. Customer Data and Account Responsibility

You are solely responsible for all information and data entered into Check Snapper.

You represent and warrant that you have the legal right and authorization to provide Q Group with all information that you enter, upload, store, or process through the Service.

You are responsible for maintaining the confidentiality of your username, password, authentication credentials, API credentials, and other account information.

You are responsible for all activity occurring under your account unless the activity resulted directly from Q Group's willful misconduct.

Q Group is not responsible for losses resulting from:

5. Customer Compliance

You are solely responsible for ensuring that your use of Check Snapper complies with all applicable federal, state, local, and foreign laws, regulations, banking requirements, tax requirements, recordkeeping requirements, employment requirements, and other legal obligations.

You may not use Check Snapper for:

6. Q Group May Modify, Suspend, or Discontinue the Service

Q GROUP NY LLC RESERVES THE ABSOLUTE RIGHT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, TO MODIFY, SUSPEND, RESTRICT, DISCONTINUE, OR PERMANENTLY TERMINATE ALL OR ANY PART OF CHECK SNAPPER AT ANY TIME, WITH OR WITHOUT NOTICE, AND FOR ANY REASON OR NO REASON.

This includes the right to:

Q Group will not be liable to Customer or any third party solely because Check Snapper or any portion of the Service is modified, suspended, restricted, or discontinued.

Where reasonably practicable, Q Group may provide advance notice of a planned permanent discontinuation of the entire Service, but Q Group does not guarantee that advance notice will always be possible or required.

7. Account Suspension and Termination

Q Group may immediately suspend, restrict, or terminate your account if we reasonably believe that:

Q Group may also terminate an account or discontinue the Service at its discretion as described above.

Termination does not eliminate obligations that by their nature should survive termination, including payment obligations, indemnification, dispute-resolution provisions, releases, limitations of liability, and intellectual-property provisions.

8. No Guarantee of Availability or Accuracy

Q Group attempts to provide a reliable Service but does not guarantee that Check Snapper will:

The Service may become temporarily unavailable because of maintenance, upgrades, outages, Internet problems, hosting problems, third-party services, security incidents, hardware failures, software failures, or circumstances outside Q Group's reasonable control.

9. Customer Must Maintain Its Own Records and Backups

THE CUSTOMER IS RESPONSIBLE FOR MAINTAINING ITS OWN BACKUPS OF IMPORTANT INFORMATION AND RECORDS.

Although Q Group may maintain backups as part of its normal operations, Q Group does not guarantee that Customer data will never be lost, corrupted, deleted, unavailable, or damaged.

Customer should maintain independent copies of important financial, banking, accounting, tax, and business records.

Q Group is not responsible for any loss resulting from the Customer's failure to maintain independent records or backups.

10. Data Processing

Customer retains ownership of its Customer Data.

Customer grants Q Group a limited right to host, store, transmit, process, reproduce, and otherwise use Customer Data solely as reasonably necessary to operate, maintain, secure, improve, and provide the Service and to comply with applicable law.

Q Group does not obtain ownership of Customer Data merely because Customer uses the Service.

Customer represents that it has all necessary rights and permissions to provide Customer Data to Q Group.

11. Intellectual Property

Check Snapper, including its software, source code, object code, designs, interfaces, graphics, trademarks, logos, documentation, functionality, and other components, is owned by or licensed to Q Group.

Except for the limited right to use the Service under these Terms, no ownership rights are transferred to Customer.

Customer may not:

12. Third-Party Services

Check Snapper may depend on or integrate with third-party services, including payment providers, email providers, hosting providers, banking-related services, authentication providers, analytics services, artificial-intelligence services, or other third-party technologies.

Q Group does not control third-party services and is not responsible for their availability, performance, security, policies, actions, errors, or failures.

Your use of a third-party service may also be subject to that provider's separate terms.

13. Payments and Subscriptions

Payments are processed by Stripe. Stripe processes card payments, taxes, refunds and renewals for purchases on our behalf.

For billing questions or refunds, email support@checksnapper.com or reply to your receipt.

Paid plans may automatically renew monthly or annually until canceled, according to the applicable plan.

Additional payment terms presented by Stripe during purchase may also apply.

When a paid subscription ends, Q Group may move the account to an available free plan or restrict paid functionality.

14. Refunds and Cancellation

Cancellation of a subscription prevents future renewal but does not necessarily entitle Customer to a refund for previously paid amounts.

Refund eligibility, where applicable, is governed by the applicable purchase and payment terms presented at the time of purchase. See also our Refund Policy.

Q Group reserves the right to provide refunds or credits at its discretion where permitted by law.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECK SNAPPER IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."

Q GROUP DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND UNINTERRUPTED OPERATION.

Q GROUP DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE SERVICE WILL ALWAYS OPERATE WITHOUT INTERRUPTION, ERROR, OR LOSS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Q GROUP NY LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SERVICE PROVIDERS, LICENSORS, AND REPRESENTATIVES (COLLECTIVELY, THE "Q GROUP PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, CONSEQUENTIAL, OR OTHER DAMAGES.

This includes, without limitation:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF Q GROUP PARTIES ARISING OUT OF OR RELATING TO CHECK SNAPPER OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU ACTUALLY PAID TO Q GROUP FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

17. Customer Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS Q GROUP PARTIES FROM AND AGAINST ANY CLAIM, DEMAND, ACTION, INVESTIGATION, LIABILITY, DAMAGE, LOSS, COST, FINE, PENALTY, JUDGMENT, OR EXPENSE, INCLUDING REASONABLE ATTORNEYS' FEES, ARISING OUT OF OR RELATED TO:

This obligation survives termination of your account and these Terms.

18. Release of Q Group Parties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND DISCHARGE Q GROUP PARTIES FROM CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF CHECK SNAPPER, INCLUDING CLAIMS RELATING TO CHECKS, BANKING TRANSACTIONS, ACCOUNT INFORMATION, PRINTING ERRORS, SERVICE INTERRUPTIONS, DATA LOSS, THIRD-PARTY SERVICES, OR YOUR DEALINGS WITH THIRD PARTIES.

You acknowledge that Q Group is providing software tools and that you, not Q Group, are responsible for the business, financial, banking, accounting, legal, and operational consequences of your use of the Service.

This release applies to the maximum extent permitted by applicable law.

19. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the maximum extent permitted by law, any dispute, claim, or controversy arising out of or relating to Check Snapper, these Terms, your account, or your relationship with Q Group shall be resolved through binding individual arbitration, rather than in court.

The arbitration shall be conducted on an individual basis.

You and Q Group agree that neither party will participate in a class action, class arbitration, collective action, or representative action against the other party, to the maximum extent permitted by law.

YOU WAIVE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RIGHT TO A JURY TRIAL FOR COVERED DISPUTES.

No arbitrator may combine claims of different customers or conduct a class or representative proceeding unless applicable law requires otherwise.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief from a court where legally permitted.

Costs. Each party pays its own attorneys' fees and costs in any arbitration or court proceeding. If you start a claim against Q Group or any Q Group Party, you are responsible for your own fees and expenses. If Q Group wins, or if the arbitrator or court finds your claim was frivolous or brought in bad faith, you will also pay Q Group's reasonable attorneys' fees and costs, to the maximum extent permitted by law.

20. No Class Actions

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND Q GROUP AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THAT PARTY'S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

You expressly waive any right to participate in a class action against Q Group or any Q Group Party, except to the extent such waiver is prohibited by applicable law.

21. No Waiver of Mandatory Legal Rights

Nothing in these Terms is intended to waive any right, remedy, or protection that cannot legally be waived.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full effect.

22. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to the arbitration provisions above, applicable proceedings may be brought in courts located in New York.

23. Force Majeure

Q Group will not be responsible for delays, interruptions, failures, or inability to provide the Service caused by circumstances beyond its reasonable control, including natural disasters, severe weather, power outages, Internet failures, hosting failures, telecommunications failures, cyberattacks, governmental actions, labor disputes, war, terrorism, epidemics, infrastructure failures, third-party service failures, or other events beyond Q Group's reasonable control.

24. Changes to These Terms

Q Group may modify these Terms from time to time.

Updated Terms may be posted through Check Snapper or otherwise provided to customers.

Your continued use of Check Snapper after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.

If you do not agree with updated Terms, you must stop using the Service.

25. Entire Agreement

These Terms, together with any applicable policies, purchase terms, privacy policies, and other agreements expressly incorporated into these Terms, constitute the entire agreement between you and Q Group regarding Check Snapper.

These Terms supersede prior understandings relating to the Service unless otherwise expressly stated.

26. No Assignment by Customer

You may not assign, transfer, or sell your Check Snapper account or rights under these Terms without Q Group's prior written consent.

Q Group may assign these Terms or its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, corporate transaction, or transfer of the Service.

27. Survival

Any provision that by its nature should survive termination will survive termination, including provisions relating to intellectual property, customer responsibility, payment obligations, indemnification, releases, disclaimers, limitations of liability, arbitration, class-action waivers, and dispute resolution.
